市地税稽查局涉外企业专项检查年度工作总结 根据市局部署安排,市地税稽查局4至6月份组织检查人员对15户涉外企业2003年至2022年地方各税费缴纳情况开展了专项检查,根据企业实际情况采取调帐检查和实地检查相结合的方式,认真详细地检查了企业的账簿、凭证、报表及有关资料。目前15户企业已检查完毕,共查补税(费)万元,加处罚款万元,加收滞纳金万元,合计万元(有4户尚在审理之中)。 一、 主要工作做法 (一) 查前吃透税收政策4月上旬,国际税务管理科就有关涉外税收政策,召集检查人员进行了查前辅导,并提出了严格的要求,通过学习,检查人员吃透了涉外企业的税收政策,做到了有的放矢。 (二) 查中宣传税收政策 由于涉外企业大多成立时很短,加上一部分财务人员素质不高,对税收政策掌握和理解不深,应在日常申报的税而未申报。检查人员问其原因,回答说是不知道要xxx种税,或是说没人告诉要xxx种税,甚至对要缴的税产生疑惑。究其原因是对税法知识不够了解。检查人员根据这种情况,不失时机的向纳税人宣传税收政策,耐心解释征税的依据和规定。很多纳税人感慨到,通过这次检查,学到了不少税收知识,避免了今后不出现或少出现类似的问题。 (三) 查后及时沟通和交流 大多数涉外企业,被查出的税款,并非主观故意偷逃税款,而是上面所说的,对税收知识不清楚不懂所致,他们对查出的税款不想因补税而罚款。很多外商主观意识上不想偷税,更不想在税收上而受到处罚,一旦受到处罚他们会责怪财务人员的。所以每查结一户,检查人员都要与企业的负责人和财务人员进行座谈,一是讲解税法的规定,取得理解,二是给企业提出加强和改进财务管理的建议。通过交流沟通,企业感受到税务人员的严格执法和真诚服务,不但按规定补交了税款和罚款,而且称赞地税良好的作风形象。 二、发现主要问题: (一)印花税申报不足 在对涉外企业地方各税进行检查时,发现涉外企业在增值税等大的税种缴纳方面还是足额的,但在地方小税种缴纳方面,尤其是印花税缴纳普遍不够足额,大部分纳税人仅对销售收入这部分分月(季)按购销合同核定申报缴纳,但在企业经济交往中, 经常与对方签订的加工承揽、建筑工程、勘察设计、财产租赁、财产保险、货物运输、技术服务、借款合同、产权转移等一些合同或协议,大多数企业财务人员对这些合同或协议不知道要缴纳印花税,有的企业在收到实收资本和增加的资本公积也没有缴纳资金帐簿印花税,他们在被查时都感到很冤枉。有一户企业在被查补的印花税中,仅上述列举的合同协议中就有六项未申报,加上资金帐簿印花税,共查补补缴了近万元的印花税。 (二)个人所得税代扣代缴不足 一是少数企业对个人所得税扣缴认识不足,认为全年平均每月达不到标准就不扣;二是大多数企业对工资以外的收入部分在计算个人所得税时不计入,如用现金发放的防暑降温费、值班补助费、加班费等,显然造成代扣不足;三是少数财务人员对个人所得税政策理解不透,造成少代扣;四是个别企业没有把担任董事职务并且取得年薪的外籍个人在外国取的收入合并计征个人所得税;五是个别企业代职工缴纳的应由个人支付的保险,未计入工资薪金所得代扣个人所得税;如某公司2022年在管理费中支付职工储金保险32万元,造成少扣缴个人所得税万元。 (三)城市房地产税申报缴纳有不足现象。城市房地产税是由于企业计税依据弄错或疏忽漏报;加上责任人未及时宣传辅导造成少缴纳。(四)个别企业对资源税应税矿产品。例如:黄砂、石子等不能足额代扣代缴。(五)水利基金缴纳仍重视不够。我们在检查的15户企业中有12户存在补缴水利基金,尤其是职工个人水利基金缴纳不足,如某公司两年补缴职工个人水利基金4000多元。(六)发票问题。少数企业在取得对方的发票时,不能对税收政策和发票管理规定掌握得很清楚,不能严格把关发票,出现收到不符合规定的发票入帐,如某企业进行工程发包,应取得建安发票,却收到国税普票和外地建安发票,容易造成对方偷逃税款。三、几点建议(一)加强对涉外企业的税法宣传和辅导尤为重要,企业对地税部门征收的一些地方税种不是主观故意不缴,而是对税法知识缺乏了解所致,征管责任人要常到企业走走,及时把税收政策、容易出现的问题告知纳税人。(二)要注重对涉外企业个人工资以外发放的现金和实物的检查,了解企业是否将工资以外的发放给个人收入部分予以扣缴个人所得税;对担任董事职务并且在本企业取得工资或年薪的外籍个人同时又有来自外国任职公司的收入部分,要督促其提供在国外取得的收入和已扣缴个人所得税的资料,以便与国内收入合并计征个人所得税。(三)在印花税征管工作中,由于大多数纳税人对印花税的概念还是不清楚,有的容易忽视,有的认为只要是对方交了,自己就不用交的错误想法,所以应加强对涉外企业印花税的宣传和管理,每次申报时要经常提醒和督促。因为涉外企业的外籍老板大多是讲究纳税信誉度的,他们不想因不懂税法而受到不应有的处罚。(四)要重视城市房地产税和资源税,督促企业按时足额申报缴纳。(五)要加强企业取得发票的审核,督促财务严格把关,从源头控管,加大处罚力度,防止错用发票的现象。
